David Holme
David Holme is on secondment as Foreign Legal Advisor to Widyawan and Partners in Jakarta. He practices principally in the energy, resources and infrastructure, mergers and acquisitions and general corporate and commercial fields, in Indonesia and other parts of South East Asia.
David's recent energy, resources and infrastructure experience includes acting on the following substantial transactions:
- advising BHP Billiton on their strategic alliance with PT Antam Tbk (an Indonesian state-owned mining company) to develop a multi-billion dollar nickel processing facility in East Indonesia, negotiating joint venture and alliance documentation with Antam and advising BHP Billiton on its application (with Antam) for a contract of work in the East Halmahera Regency of Indonesia;
- advising BHP Billiton on a range of strategic investments throughout Asia (and beyond) including the signing of a bauxite exploration concession in Cambodia, its investment in the multi-billion dollar Sangaredi Alumina Refinery in the Republic of Guinea and BHP Billiton's proposed strategic investment in a Mongolian coal mining project;
- advising PT Shell Indonesia on a series of fuel supply and storage terminal construction arrangements in Indonesia, including associated joint venture arrangements;
- on secondment to ExxonMobil, acting on a number of asset sales being undertaken by ExxonMobil subsidiaries, and negotiating joint venture and unitisation documentation in connection with ExxonMobil's licence interests, throughout the Asia Pacific region;
- acting for the Macquarie Bank consortium regarding its purchase of the Dampier-to-Bunbury Natural Gas Pipeline in Australia, and advising on regulatory issues associated with the acquisition; and
- acting for a range of private and Government parties on the negotiation of petroleum agreements for petroleum projects in Indonesia and elsewhere in the region, including Santos, Black Gold Energy and the Royal Government of Cambodia.
David has also acted on a number of significant mergers and acquisitions, and general corporate and commercial transactions, in Indonesia and elsewhere in the region for clients such as Bayer AG, Siemens AG, Brambles, Experian and Wesfarmers.
Finally, David also has significant experience in advising Government and industry participants on regulatory policy and regulatory reform in the Asia Pacific region.
